These terms govern your use of the RoofingFox website and the engagement of our roofing services. Please read them carefully before submitting any request.
1. Acceptance of Terms
By accessing or using the RoofingFox website (roofingfox.site ) or by engaging RoofingFox ("RoofingFox," "we," "us," or "our") for any roofing service, you ("user," "client," or "you") agree to be legally bound by these Terms of Service and all applicable laws and regulations.
If you are accessing our website or engaging services on behalf of a company, partnership, or other legal entity, you represent and warrant that you have the legal authority to bind that entity to these terms. If you do not agree with any part of these terms, you must not use our website or engage our services.
Important: These Terms govern website use and provide general service terms. Each specific roofing project is governed by a separate written service agreement signed by both parties. In any conflict between these Terms and a signed service agreement, the service agreement prevails for matters relating to that specific project.
2. Website Use
Permitted Use
You may access and use our website to learn about our roofing services, request estimates, read our Insights articles, and contact us for legitimate purposes. You agree to use the website only for lawful purposes and in a manner that does not infringe the rights of any third party or restrict others' use of the site.
Prohibited Activities
You may not:
- Submit false, fraudulent, or misleading information through any website form or inquiry channel
- Attempt to gain unauthorized access to any portion of our website, servers, or connected systems
- Use automated tools including bots, scrapers, or crawlers to harvest data from the website without written permission
- Transmit malicious code, viruses, ransomware, or any other harmful software through our website
- Impersonate RoofingFox, any of our employees, or any other person or entity
- Reproduce, distribute, or create derivative works from any website content without explicit written authorization
- Use our website or services in connection with any unlawful activity
RoofingFox reserves the right to terminate access or restrict use for any user who violates these prohibitions, with or without notice.
3. Service Engagement
Submitting an estimate request, contact form, or any other inquiry through our website or by telephone does not create a binding service contract. A binding contract for roofing services is formed only when both RoofingFox and the client have executed a written service agreement that specifies the agreed scope of work, materials, pricing, timeline, and warranty terms.
All roofing services are further contingent upon:
- Completion of a site inspection confirming project scope, structural conditions, and feasibility
- Receipt of any required deposit as specified in the written service agreement
- Issuance and receipt of any required building permits from applicable local authorities
- Access to the property on the scheduled installation date
RoofingFox reserves the right to decline any service engagement at our sole discretion, including when a property falls outside our service area, when site conditions present safety concerns that cannot be adequately mitigated, or when our current scheduling capacity would not allow us to deliver the project at our quality standard.
4. Estimates, Proposals, and Pricing
Any pricing information displayed on our website — including maintenance plan pricing for the Essential Shield, Summit Guard, and Apex Total plans — represents standard starting-point pricing based on typical residential properties within our primary service area. Website pricing is not a binding offer and does not account for property-specific variables.
Binding project pricing is provided through a written proposal issued after an on-site inspection. Written proposals are valid for 30 days from the date of issue unless a different validity period is stated in the proposal. Pricing for design and installation projects varies based on:
- Roof square footage, pitch, and complexity
- Current market pricing for specified materials
- Deck condition and any required structural remediation
- Required permitting, fees, and disposal costs
- Seasonal scheduling factors and material availability
Maintenance plan pricing as shown on the website applies to residential properties up to 3,500 square feet. Larger residential properties, commercial buildings, and multi-unit structures receive custom maintenance proposals after site assessment.
5. Workmanship Guarantee
RoofingFox provides a 10-year workmanship guarantee on all residential roof replacement projects completed under a signed service agreement. The Apex Total maintenance plan clients receive an extended 15-year workmanship guarantee as specified in the plan terms.
This guarantee covers defects in installation workmanship that cause roof failure or water infiltration under normal operating conditions. Key terms of this guarantee:
- The guarantee is transferable to a subsequent property owner within the guarantee period, subject to written notification to RoofingFox within 30 days of ownership transfer
- The guarantee requires that the property owner follows any written maintenance recommendations provided at project completion. Failure to perform recommended maintenance may void the guarantee for defects attributable to that omission
- The guarantee does not cover damage caused by extreme weather events (including but not limited to hail, hurricane-force winds, and wildfire), acts of God, structural settlement, unauthorized modifications to the roof, or improper repairs performed by parties other than RoofingFox
- This guarantee is separate from, and in addition to, any manufacturer material warranties activated on qualifying installations
To invoke the workmanship guarantee, contact us in writing at info@roofingfox.site with a description of the issue and photographs. We will schedule an inspection within 10 business days of receiving a complete warranty claim.
6. Payment Terms
Payment terms for individual roofing projects are established in each written service agreement. Our standard payment structure for residential replacement and installation projects is:
- A deposit of 30–50% of the total contract value, due upon signing the service agreement and before material ordering begins
- Progress payments at agreed milestones for larger or multi-phase projects, as specified in the service agreement
- Final payment of the remaining balance, due upon project completion and client walkthrough acknowledgment
For insurance claim projects, payment timing is coordinated with the insurance disbursement schedule as specified in the service agreement. Maintenance plan billing is processed monthly at the beginning of each service month. Accepted payment methods include ACH bank transfer, major credit cards, and business check.
Balances remaining unpaid beyond 15 days of the due date may accrue a finance charge of 1.5% per month on the outstanding balance. RoofingFox reserves the right to suspend ongoing service obligations pending resolution of overdue balances.
7. Cancellation and Plan Changes
Replacement and Installation Projects
Cancellation of a signed service agreement by the client after material ordering has commenced may result in charges covering ordered materials (at actual cost), work completed through the cancellation date, and reasonable administrative processing costs. Specific cancellation terms and any applicable fees are detailed in each written service agreement.
Maintenance Plan Cancellation
Maintenance plans may be cancelled by the client with 30 days' written notice delivered to info@roofingfox.site or to our physical address. No refunds are issued for the current billing month in which cancellation notice is received. The plan remains active through the end of the final paid month.
Plan Tier Changes
Upgrades or downgrades between maintenance plan tiers require 14 days' written notice and take effect at the start of the next billing cycle following the notice period. Billing adjustments reflect the new tier pricing from the effective date of the change.
8. Insurance Claims Assistance
RoofingFox provides insurance claim documentation assistance as part of our storm damage and hail damage services. When requested, our HAAG-certified inspectors produce documentation formatted for insurance adjuster review and can participate in co-inspections with your insurance adjuster.
Important limitations regarding our insurance assistance services:
- We are roofing contractors, not licensed public adjusters or insurance professionals. Our role is to provide accurate documentation of observed physical conditions, not to negotiate insurance claims on your behalf.
- Claim decisions, payment determinations, and coverage interpretations are made exclusively by your insurance company and are outside our control or influence.
- We do not charge separately for standard insurance documentation as part of a project we are engaged to repair or replace. Documentation fees for standalone inspection-only engagements are specified in the inspection proposal.
- We strongly advise clients not to sign Assignment of Benefits (AOB) agreements with any contractor that transfers their claim rights. We do not request or require AOB arrangements from our clients.
9. Limitation of Liability
To the maximum extent permitted by applicable Colorado and federal law, RoofingFox' total liability to you for claims arising solely from use of this website — separate from liability for contracted roofing services — shall not exceed one hundred dollars ($100.00). This limitation applies to all causes of action in the aggregate, including breach of contract, tort, negligence, strict liability, and any other legal or equitable theory.
RoofingFox shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from website use or reliance on website content, including information published in our Insights articles.
Liability for individual roofing service projects is governed by the specific limitation of liability provisions in each executed service agreement, which are negotiated on a project basis and may differ from the website use limitations stated above.
10. Intellectual Property
All content on this website — including text, photography, Insights articles, graphics, the RoofingFox name and logo, service names (Essential Shield, Summit Guard, Apex Total), and the overall site design and architecture — is the intellectual property of RoofingFox or is used under license, and is protected by applicable copyright, trademark, and intellectual property laws.
You may view and share website content for personal, non-commercial purposes with appropriate attribution to RoofingFox. You may not reproduce, republish, sell, license, modify, or create derivative works from any website content without prior written consent. Requests for content republication may be directed to info@roofingfox.site.
11. Results Disclaimer
Roofing project outcomes — including installation timelines, cost estimates, material performance, roof lifespan, and insurance claim results — vary based on factors including but not limited to: property-specific structural conditions, material availability and pricing, seasonal weather during installation, individual insurance policy terms and adjuster determinations, ongoing maintenance practices, and regional climate conditions.
Testimonials, client reviews, and project references displayed on this website reflect individual experiences and should not be interpreted as guarantees of identical or similar outcomes for your specific project. Roofing system lifespan estimates are based on manufacturer ratings under standard conditions; actual performance may differ based on Denver-area altitude, UV exposure, hail frequency, and thermal cycling conditions.
Nothing in our website, marketing materials, or verbal communications constitutes a warranty of specific project performance except as explicitly stated in a signed written service agreement or in our written workmanship guarantee documentation.
12. Dispute Resolution
We encourage clients to contact us directly at the first sign of any concern — most issues are resolved promptly through direct communication. If a dispute cannot be resolved through direct discussion within 30 days of written notice:
- Both parties agree to attempt mediation through a mutually agreed Colorado-based mediator before pursuing arbitration or litigation
- Any dispute that is not resolved through mediation shall be submitted to binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association, conducted in Denver, Colorado
- Each party shall bear its own attorneys' fees unless the arbitrator determines that a party has acted in bad faith
- You agree that any dispute resolution proceedings will be conducted on an individual basis. Class action waiver: you waive any right to participate in class action or representative proceedings to the extent permitted by applicable law
Disputes relating to specific contracted roofing projects are subject to the dispute resolution provisions in the relevant written service agreement, which supersede these general website Terms for project-specific matters.
13. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. Subject to the arbitration clause above, any court proceedings arising from these Terms shall be brought exclusively in the state or federal courts located in Denver County, Colorado. You consent to personal jurisdiction and venue in those courts for any proceedings not subject to arbitration.
